Dwayne Wade Ex, Funches-Wade, Receives $5M in Divorce Settlement, But Must Keep Quiet About NBA Star

Dwyane Wade's ex will receive $5 million in a divorce settlement from her NBA star ex-husband, according to reports.

The settlement agreed by both parties also includes a "non-disparage" agreement, prohibiting each party from making disparaging remarks about the other in public.

In addition to receiving $5 million, Funches-Wade will also receive the couple's mansion in South Holland, as well as four of their cars.

A judge found the settlement valid, despite Funches-Wade's attorney, Brian Hurst, arguing that his client had never fully agreed to all the provisions in the settlement – especially the "non-disparage" part. However, Cook County Circuit Court Judge John Thomas Carr disagreed and ruled that the settlement would remain effective, and that the ex-couple's six year divorce proceedings are finally brought to an end.

Wade's attorney will look to iron out exactly what would constitute a disparaging remark, but it will likely include anything disparaging about Wade, his family, as well as his new girlfriend, Gabrielle Union.

Funches-Wade was furious with the judge's decision to effect the settlement, telling reporters outside the courtroom, "My voice isn't for sale, my story isn't for sale, no thank you."

Funches-Wade was in the news just last Friday, when she protested outside the Daley Center, holding up a cardboard sign saying, "NBA Miami Heat star, mother of his children on the streets." She claimed that Wade had not been keeping up with his $25,000 a month spousal support.

Wade's attorney, James Pritikin, issued a statement on Monday in response: "Dwyane Wade has made several requests over the years to settle this matter, despite Ms. Funches having 16 different attorneys and 2 arrests throughout this process. Mr. Wade has provided a very generous settlement to Ms. Funches to continue to live a wonderful lifestyle for the rest of her life.

"Despite false allegations by Ms. Funches claiming to be 'homeless' and 'destitute,' Dwyane Wade has maintained over the years financial support to his ex-wife by providing her with income over $25,000 on a monthly basis, timely paid for her home mortgage, maintenance and security at the house, 4 cars, insurance, taxes and all of her attorney fees throughout this process.

"Ms. Funches has made a mockery of homelessness which is a serious and personal issue for Mr. Wade as his mother was homeless for a period of time when he was a child. Dwyane Wade was awarded sole custody of their sons by the court in 2011."

"The safety and well-being of his children are his main priority. Due to Ms. Funches' current unstable mental state, her visitation will be determined by the court. Mr. Wade continues to hope that one day he will have a civil relationship with his ex-wife for the sake of their sons."

The couple was originally married in 2002, and share two sons, Zion and Zaire, together. However, Wade filed for divorce in 2007, and that was effected in 2010, although legal wrangling over the settlement has continued until now.

Wade was granted sole custody of their children in 2011.
